How the overtime pay calculation works

Overtime under the Fair Labor Standards Act is one and a half times the regular rate for hours over 40 in a workweek. The subtlety is in the phrase 'regular rate', which is not always the base hourly wage.

Non-discretionary bonuses, shift differentials, and production incentives all have to be included when computing the regular rate. Divide total straight-time earnings including those payments by total hours worked, then apply the multiplier. Using the base rate alone is one of the most common wage-and-hour violations.

Do salaried employees get overtime?
